Hungary has informed the European Commission that it will not comply with the EU Temporary Protection Directive regarding the prohibition on granting protection to individuals who have unfulfilled military obligations to Ukraine.

Details: Hungary will exercise its right of partial application of the EU Temporary Protection Directive to continue offering asylum to those fleeing Ukraine to avoid military service.

Quote: "Member states have the possibility to exert their discretion when it comes to applying the framework of the Council [of the EU] decision and the Temporary Protection Directive. This is provided for in Article 7 of the Temporary Protection Directive, and we were informed by Hungary in that regard that they are doing that."

Details: Lammert recalled that the EU Council decided that "temporary protection should in principle not be granted by the member states to newly arrived persons who are not authorised by the Ukrainian authorities to leave Ukraine in view of their military obligations".

Quote: "There are certain discretion for member states when implementing this, and this is where we are."

Background:

  • As reported by European Pravda, Hungarian Prime Minister Péter Magyar stated on 3 September that Hungary will continue to provide protection to Ukrainian men of military age, primarily those from the border region of Zakarpattia.
