Horbatiuk: Relations between GPU, NABU and SAP Are Far From Ideal

The Chief of Special Investigation Department of the Prosecutor General’s Office (GPU) Serhii Horbatiuk claimed that the relations between the GPU, National Anti-Corruption Bureau (NABU) and Special Anti-Corruption Prosecutor’s Office (SAP) were hardly ideal. He also shared his idea to appeal his ban from the position of the State Investigation Bureau (DBR) Director. He said this as he commented the selection process in an interview to Segodnya newspaper.  

"I don’t have enough managerial experience, they said. Formally, I was a manager for 2 years and 3 months. But the law does not specify exactly what a managerial position is," Horbatiuk said. "I was managing investigative groups comprised of 20 or even 50 professionals multiple times. Is it a managerial position? I think so. Thus, I will appeal the decision of the selection panel to disregard my application," he added.

He also stressed that the DBR ‘had not been established yet.’ The Maidan cases may be investigated by the prosecutor’s office, but after the law on the DBR is enacted, the issue of duplication of competence may become a ticking bomb, he said. Finally, the relations between the GPU, NABU, and SAP ‘are not always perfect,’ Horbatiuk claimed.

According to him, the main discrepancy concerns the issue of competence with regard to offences committed by top officials. The law says it belongs to the NABU, he uttered. But sometimes it is not clear from the very beginning of the case either the NABU or GPU has the key role to play… And when it comes to bribe-taking, prompt action is required… So, an effort is needed to prevent conflict of interest," Horbatiuk summarized.
